Terms and Conditions
Creative Measures Academy (hereinafter Academy) has been created to go beyond where the classroom lessons leave off and provide a performance element and the necessary tools that will enhance artist development, overcoming stage fright, working on stage presence, and perfecting the overall performance. The following terms and conditions will govern the relationship between the Academy and its students:
1. Enrollment and Registration:
a. By enrolling in the Academy, you agree to provide accurate and complete information during the registration process.
b. In order to participate in the Academy, we require you to enroll in the Academy by utilizing the platform Teacher Zone. A link to the Teacher Zone App will be sent to you during the enrollment process to register. Please note, Teacher Zone is a third party learning management system platform. c. Registration Process:
i. By enrolling in the academy, you will be required to register an account on Teacher Zone, through the Academy’s website.
1. You may be required to enter the following information:
a. Home phone number
b. Physical Address
c. Student’s Full Name
d. Email Address
e. Cell phone number
f. Birthdate
g. Gender
h. School
i. Grade level
2. You will then be required to create a username and password.
3. Next, you will choose the lesson plan type you wish to enroll in.
4. You may be asked to answer a few questions.
5. A contract will be assigned to you based on your lesson plan type. You will then sign the appropriate contract and enter your payment method details.
ii. You agree to keep your username, and password confidential and will be responsible for all use of your account and password.
iii. We reserve the right to remove or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
d. Tuition and Fees:
i. Tuition fees are due on the first of each month and must be paid in full by the designated deadlines.
ii. Late payments may result in additional fees or suspension from classes.
2. Lesson Schedule, Attendance, and Punctuality:
a. Lesson schedule is based on the availability of the student and the availability of the Instructor.
b. Regular attendance is crucial for progress. Please notify the academy via Teacher Zone in advance of any absences or schedule changes as soon as possible.
c. Music lessons begin at the designated scheduled time. Students are allowed a ten (10) minute grace period before the lesson is canceled. Please strive to be punctual for all sessions.
d. Lesson Cancellations:
● Canceled by Instructor:
It is the Academy’s mission to provide students with quality services. As such, lessons cannot be missed. The Academy understands that an emergency or sickness does occur that may prevent an Instructor from conducting a lesson. In these events, it is the Instructor's responsibility to inform the Academy via Teacher Zone platform and the student as soon as possible and arrange to make up the lesson. The new time and date has to be updated via the Teacher Zone platform. Make-up lessons must be completed
within 20 days of the cancellation.
● Canceled by the Student:
If a lesson is canceled with less than 24-hours notice, no makeup lesson will be provided unless there has been an emergency (approved by the Academy) or the student is sick. Each student
gets one sick makeup lesson per month unless otherwise approved by the Academy. Approved cancellations will be banked in the student portal.
3. Code of Conduct:
a. Respect for instructors, fellow students, and academy property is mandatory at all times.
b. Any disruptive or disrespectful behavior may result in disciplinary action, including expulsion.
c. Alcohol and drugs are strictly prohibited on the Academy's premises. As such, students shall not be under the influence of any substance, or in relation to any substance, have an offensive odor while participating in a lesson. If this portion of the policy is violated, the Academy reserves the right to refuse the lesson.
d. Effective communication among students, parents, instructors, and the Academy is paramount to the success of the program. Please ensure that you communicate any issues that may arise to the proper parties.
e. Attire
- Standard attire:
The Academy urges the use of common sense and sound judgment when it comes to selecting attire. Attire should not be too revealing or offensive.
- Recital attire:
Standard performance attire is required during recitals.
● All clothing should be clean, ironed and in good shape.
4. Curriculum and Materials:
a. Students are responsible for acquiring their instrument and adhering to the curriculum.
b. Unauthorized sharing or distribution of academy-provided materials is strictly prohibited.
5. Intellectual Property
All academy-created content, including lesson plans and materials, is intellectual property protected by copyright laws. Reproduction or distribution without explicit permission is strictly prohibited.
a. Ownership of Intellectual Property:
i. All original works created by instructors or students within the scope of their employment or enrollment at the Academy shall be considered the property of the Academy, unless otherwise agreed upon in writing.
ii. Instructors and students retain ownership of any pre-existing intellectual property brought into the academy, unless expressly assigned or licensed to the academy.
b. Use of Intellectual Property:
i. Instructors and students are granted a non-exclusive, non-transferable license to use academy-owned intellectual property solely for educational purposes within the academy's programs.
ii. The Academy reserves the right to use, reproduce, distribute, and display any intellectual property created by instructors or students for promotional or educational purposes, with appropriate attribution.
c. Protection of Intellectual Property:
i. Instructors and students are responsible for respecting the intellectual property rights of others and not using copyrighted materials without proper authorization or licensing.
d. Innovation and Collaboration:
i. The Academy encourages innovation and collaboration among instructors and students while respecting intellectual property rights. Collaborative works should be clearly documented, and ownership rights should be agreed upon in advance.
e. Enforcement and Compliance:
i. Violations of this intellectual property policy may result in disciplinary action, including termination of employment or enrollment, as well as, legal recourse for damages or injunctions.
ii. All instructors, students, and parents of students are required to familiarize themselves with this intellectual property policy and adhere to its provisions.
f. Policy Review and Updates:
i. This intellectual property policy shall be reviewed periodically to ensure its effectiveness and compliance with applicable laws and regulations. Updates or revisions may be made as necessary, with notice provided to all relevant stakeholders.
6. Termination of Enrollment
a. The academy reserves the right to terminate enrollment for violations of terms, and/or disruptive behavior.
b. Tuition fees are non-refundable in such cases.
c. If termination is on the part of the student or parent/legal guardian of a student, any prepaid unfulfilled lessons will be refunded, granted a two week notice of termination is provided. If no notice is provided, any prepaid unfulfilled lessons will not be refunded.
7. Privacy and Data Security
a. Personal information collected during enrollment will be used solely for administrative purposes and will not be shared with third parties without consent.
b. By enrolling in the Academy, the student or parent/legal guardian of the student agrees to utilize the learning management system platform, Teacher Zone. Please see Teacher Zones’ Privacy Policy for more information on how they collect, use, and protect personal information provided by the students. Please utilize the

c. We confirm that we will keep your information secure and adhere to data protection laws and regulations.
8. Safety and Liability
a. The Academy is not responsible for any loss of personal property during lessons or events. Students are advised to keep their belongings secure.
b. The Academy is not liable for any accidents or injuries sustained during lessons or events. Students, parents of students, and legal guardians of students will be requested to sign a medical release form, granting permission for emergency medical treatment if necessary and releasing the Academy of any liability that may occur during the administration of the emergency medical treatment.

10. Communication

11. Governing Law and Jurisdiction
North Carolina law is the governing law and jurisdiction that will be used to interpret and enforce the terms and conditions of the Academy.
By enrolling in our music academy, you acknowledge that you have read and agree to abide by these terms of service. The academy reserves the right to update these terms as needed, and any changes will be communicated in advance.
